This bill amends the process for disposing of exhibits used in criminal proceedings, specifying that non-firearm, non-contraband exhibits not ordered for return and not part of another pending case may be disposed of after certain timeframes. For misdemeanors, eligible exhibits can be disposed of one year after conviction finalization; for felonies with a sentence of five years or less, two years after conviction finalization; and for noncapital felonies with longer sentences, 10 years after. Additionally, disposal can occur one year after a defendant's acquittal or death. If an exhibit is involved in multiple trials, it can be disposed of after the longest applicable period based on specific conditions. The bill is set to take effect Sept. 1, 2025.
