The bill permits health plan issuers to change drug coverage during plan renewal, provided they uniformly implement changes and notify affected parties 60 days in advance. Modifications can include removing drugs from formularies or altering cost-sharing requirements. Favorable changes, like adding drugs to formularies, can occur anytime without notification. Importantly, upon renewal, issuers cannot downgrade coverage for drugs previously prescribed and covered for an enrollee’s condition unless there are safety concerns or discontinuation by the FDA or manufacturer. The changes apply to plans renewed on or after Jan. 1, 2026.
