The bill amends the Insurance Code to require health benefit plans covering prescription drugs to apply any reduction in out-of-pocket expenses made on behalf of an enrollee for essential health benefit drugs to the enrollee’s deductible, copayment, cost-sharing responsibility, or out-of-pocket maximum. This applies whether or not the issuer or pharmacy benefit manager classifies the drug as an essential health benefit. It includes prescriptions without generic or interchangeable biological equivalents or those accessed through prior authorization, step therapy, or exceptions processes. The amendments apply to health benefit plans delivered, issued, or renewed on or after Jan. 1, 2026. The Act takes effect on Sept. 1, 2025.
